Mistrial Declared in Fatal Hit-and-Run Case of 8-Year-Old Boy [CHESAPEAKE, VA]
CHESAPEAKE, Va. — A mistrial has been declared in the Fatal Hit-and-Run Case involving the death of 8-year-old Forrest Hooper, a Chesapeake boy struck by a vehicle last October. The accused, Richard Humbert, 39, faces charges for failing to report an accident that resulted in injury or death and failing to stop after the collision that occurred on October 3, 2023.
On the day of the accident, around 4:15 p.m., prosecutors stated that Humbert, driving a white Honda Civic, hit young Forrest as he attempted to cross the 1700 block of South Battlefield Boulevard in the Great Bridge area. Despite the impact, Humbert did not stop at the scene. Instead, he continued driving and pulled into a Wawa gas station approximately a quarter-mile away, mistakenly believing he had hit a deer, according to his defense team. He neither reported the accident nor filed an insurance claim afterward.
The trial, which began on a Monday morning, was abruptly halted the next day when Judge Stephen Telfeyan declared a mistrial. The judge had originally instructed the jurors not to make conclusions before all the evidence, testimony, and closing arguments had been presented. Jurors were also forbidden from conducting independent research, visiting the scene, or performing any internet searches related to the case.
However, by Tuesday, it became evident that these instructions had not been followed. Judge Telfeyan explained to the 14 jurors that there had been independent research, discussions among jurors, and premature conclusions reached. Though the judge did not single out any specific juror, he made it clear that the behavior compromised the integrity of the trial. As a result, a mistrial was declared, and a new trial date will be set, expected to occur in either October or November.
Forrest Hooper’s family, including his grandmother, expressed disappointment over the mistrial but remained optimistic. “We are understandably disappointed with today’s events. However, we do have full faith and confidence in the Commonwealth’s case, and we are anxiously awaiting a new trial date,” she said after the mistrial was announced. The family continues to grieve the loss of their beloved boy, whom the community remembered as a “remarkable little boy” who brought people together in the aftermath of the tragedy.
The physical evidence from the scene painted a devastating picture. According to testimony from a Chesapeake police officer and a forensic specialist, Forrest’s Nike sneakers were found on opposite sides of Battlefield Boulevard. His cell phone was discovered over 50 feet away from one of the shoes, illustrating the severity of the impact.
