Fatal Excavator Crash Claims 21-Year-Old in Newport News [NEWPORT NEWS, VA]

Fatal excavator crash claims 21-year-old in Newport News after a devastating accident occurred late Sunday night along the eastbound lanes of Interstate 64. Virginia State Police responded to the scene just before midnight, near Oyster Point Road, following reports of a single-vehicle collision involving heavy construction equipment.

According to preliminary findings from troopers, the victim—identified as Rishard Bernard Brummell Harvey—was driving a 2010 Chrysler Sebring eastbound when, for reasons still under investigation, he veered off the roadway. The vehicle first struck an attenuator, a protective barrier typically used in highway work zones, before continuing into an inactive construction site. Tragically, the car then collided with a parked excavator.

The impact caused the vehicle to erupt into flames, leaving Harvey trapped inside. Despite efforts from first responders, he was unable to escape and died at the scene from his injuries. Officials confirmed that the construction site was inactive at the time of the crash, and no construction workers were present.

As the investigation continues, authorities are working to determine what may have led Harvey off the road and whether any other factors, such as road conditions, signage, or vehicle malfunction, played a role. Toxicology results and further reconstruction of the incident are pending to establish a full picture of the events leading to the fatal crash.

At Briet Law Attorneys, we understand that accidents like these leave families devastated and searching for answers. While no legal action can bring back a loved one, surviving family members may be entitled to pursue a wrongful death claim. In cases involving construction zones, even when inactive, questions often arise regarding whether proper safety measures, lighting, or barriers were in place. Victims’ families may seek compensation for funeral expenses, loss of future income, emotional suffering, and other damages tied to negligence. If third parties, such as construction companies or state contractors, failed in their duty to maintain a safe worksite, they may be held accountable.

Our legal team at Briet Law is committed to helping families navigate these difficult moments. We conduct thorough investigations, collaborate with accident reconstruction experts, and fight to ensure every responsible party is identified. We don’t just represent our clients — we stand beside them every step of the way.

This tragic incident serves as a sobering reminder of the dangers that can arise on our roads, especially in areas undergoing maintenance or construction. As we await more details from the ongoing investigation, our thoughts remain with the family and friends mourning this heartbreaking loss.
